Dear Mr Holland, Thank you for your recent email to us regarding this dispute. I am sorry to hear about each point you make here. Unfortunately to say it is your word against the stores and the legal documents are there to back up any dispute of this nature. After speaking with the store manager it is his decision that a miss-sell did not occur. Because of this there is nothing more we can do to help you. I hope this information is sufficient. If your require any additional assistance or have any more queries please reply to this email. Alternatively you could call our Customer Service team on 0870 0870 087. Kind Regards, Rob Price Customer Support Carphone Warehouse Customers Message Follows: ------------------------
Dear sir/maddam
I took a contract out on the 2nd September 2009 at Carphone Warehouse, Monks Cross, York which is what i believed for 18 months. When i signed the contract the girl "Sammy" said don't worry i will knock the contract down to an 18 month. Stupidly i took her word for it, however i thought i could trust your staff in not miss selling contracts. I mentioned when taking the contract i have aspergers and if she could help me. Seems to me she was taking advantage.
Therefore i will only be paying orange up until March 2011, after that it's not in my hands. If you can't resolve this directly now. I have no option but to speak to yorkpress, trading standards and ofcom.
All you have said so far is a) i signed it, yes i did sign it but i have aspergers and trusted the girl not to miss sell and b) the girl doesn't work there anymore. Not my problem, it's your problem. I shouldn't be penolised for a member of staff leaving the company.
You repeat time after time i signed a 24 month contract. CORRECTION. I WAS MISSOLD A 24 MONTH CONTRACT.
Speaking to staff at Monks Cross is very difficult. Very rude, very abrupt, no customer care.
Phones4u have brilliant customer care. Shame your company doesn't.
My number is ********** which was my old number my number i changed to ***********.
Sort it out for face action. Failure to resolve means i will take this to yorkpress.
KR
Tom Holland

Did you sign the contract with it stating that it is a 24 month contract therefore accepting the terms of the length?

Pah. Aviod CPW at all costs.
You wont win. I'd go see the salesperson herself and see what she has to say.
But as Jack says, if you've signed something that states 24month. Then more fool you. You've got no chance of getting out of that one.

A mate of mine had problems with his phone contract a while back, I'm pritty sure that was Carphone Warehouse. His solution? Well, he worked for Ministry Of Justice (Courts) and sent a letter to Carphone Warehouse with MoJ letterhead, threatening action! He soon got an apology! Wouldn't recommend doing that though...

One would hope that he got permission from his superiors to do that?

I wouldn't do that as that would just agitate the member of staff you're dealing with and blow the whole situation out of all proportion. You wouldn't want to be on the other side of the lens dealing with an annoyed customer?

Went into the store today, staff very rude, banned us for making legal action threats and called security. My friend secretly recorded on his mobile phone as store manager said "if you got problems personally with me i will gladly meet you at 7pm when i finish" is that a threat ? anyway recording been posted off to head office. Lets see there staff in action.

Wont do you much good apart from the store staff being reprimanded. Also, you may get a gratuity dependant on your attitude in the store too. You must have done something wrong to get that reaction!
Also, they cant go back and change such things, you have to deal with the customer service agents on the phone.
Have you signed the contract with states 24month?

I raised my voice on the phone to the store and swore, something they can not prove. Yes i did sign 24 months but the girl said it was a type error. She sold the contract in a very cunning way.

Well why did you sign it? Surely you should've got a replacement and signed that? Sadly you have no leg to stand on.
Maybe you shouldn't have raised your voice and swore at them and you wouldn't have got the 'threat' you got. You are partially to blame for the whole incident.
Oh and for the record, if you had swore at me, i'd of thrown you out of the store myself.

I never swore instore i was very calm and cool as a cucumber. We said we demand area manager details something we are advised to do by citizens advice and that is a legal right for anyone to see their contract the guy at CPW refused. Even if i swore over the phone it cannot be proved yet this guys behavior can.

Most call centres record calls don't they.
